Terms of Service

Welcome to Phanes Labs. Please read these Terms of Service ("Terms") carefully before using our website and services, including the Kratos app and the Deskwork web app (together, the "service"). The service is operated by Phanes Labs, Heidelberger Str. 80, 12435 Berlin, Germany (see our Imprint).

1. Agreement to Terms

By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the service.

2. Intellectual Property

Our platform and its original content, features, and functionality are and will remain the exclusive property of Phanes Labs and its licensors. The service is protected by copyright, trademark, and other applicable laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Phanes Labs.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and up-to-date information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the credentials used to access the service and for any activities under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. User Content

Our service allows you to create and store information such as training data, messages, files, and other material ("Content"). You are responsible for the Content you create or upload, including its legality, reliability, and appropriateness. We do not claim any ownership rights to your Content, but we have the right (not the obligation) to remove Content that, in our sole discretion, violates these Terms or applicable law.

5. Health and Fitness Disclaimer

Kratos and any AI coaching features provide general fitness information only. They are not medical advice and are no substitute for professional medical guidance. Consult a physician before beginning any exercise program, and stop exercising immediately if you feel pain, dizziness, or discomfort. Physical training carries inherent risks; you use the service and perform any exercise at your own risk. AI-generated suggestions may be inaccurate — use your own judgment.

6. Purchases and Subscriptions

Optional paid features of the Kratos app (such as cloud backup and the AI coach) are offered as in-app purchases or subscriptions through the app store you installed the app from (Apple App Store or Google Play). Billing, renewal, and cancellation are handled by that store under its terms; you can manage or cancel subscriptions in your store account settings. Refunds are handled by the store, except where applicable law requires otherwise. Statutory withdrawal rights for EU consumers remain unaffected.

7. Limitations of Use

By using our service, you agree not to:

• Use the service in any way that violates applicable law or regulation.
• Use the service in any manner that could disable, overburden, damage, or impair it or interfere with any other party's use of the service.
• Use any robot, spider, or other automatic device or process to access the service for any unauthorized purpose.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the service or any connected server, computer, or database.
• Attack the service via a denial-of-service attack.
• Otherwise attempt to interfere with the proper working of the service.

8. Changes to Service

Phanes Labs reserves the right to withdraw or amend our service, and any material we provide via the service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the service is unavailable at any time or for any period.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, if you breach the Terms. Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may simply discontinue using the service or contact us to request account deletion. Kratos data stored locally on your device remains yours and is unaffected by account termination.

10. Limitation of Liability

Phanes Labs is liable without limitation for intent and gross negligence, for injury to life, body, or health, and under mandatory statutory liability (e.g. product liability law). For slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Any further liability — including for indirect, incidental, or consequential damages, loss of profits, or loss of data — is excluded to the extent permitted by law.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law provisions. If you are a consumer, mandatory consumer protection rules of your country of habitual residence remain unaffected.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. By continuing to use our service after those revisions become effective, you agree to be bound by the revised Terms.
